Welcome to FITGym. These Terms & Conditions (“Terms”) govern your use of our facilities, services, and website. By joining our gym and/or using our services, you agree to these Terms.
1. Membership
1.1. Types of Membership
We offer various membership plans, including casual and fortnightly. Details of these plans, including pricing and benefits, are available at our reception or on our website.
1.2. Membership Agreement
By signing up for membership, you enter into a contract with FITGym. Membership fees are due as outlined in your chosen plan.
1.3. Cancellations & Freezes

Cancellation: Members may cancel their membership by providing 4 weeks notice. This can be done via the FITGym app, membership account, in-person or via email.

Freezes: Memberships can be frozen for medical or other valid reasons for up to 3 months. Requests must be submitted in writing or actioned by the membership holder on their own account.
1.4. Termination
FITGym reserves the right to terminate memberships for non-payment, violation of Terms, or inappropriate behaviour, including harassment or misuse of equipment.
2. Gym Use
2.1. Access
Access to our facilities is granted to active members during operating hours. Members must present a valid membership upon entry.
2.2. Conduct
Members must:

Follow gym rules and staff instructions.

Use equipment safely and return it to its proper place.

Respect other members and maintain a positive environment.
2.3. Health & Safety

Members are responsible for ensuring they are fit to exercise. FITGym recommends consulting a healthcare provider before beginning any new exercise program.

Use of equipment and facilities is at your own risk. FITGym is not liable for any injuries sustained while using our facilities.
2.4. Dress Code
Appropriate workout attire and footwear are required at all times.
3. Facilities & Services
3.1. Personal Training
Personal training sessions must be booked in advance. Cancellation or rescheduling requirements varies for each trainer.
3.2. Facility Maintenance
Scheduled maintenance and cleaning may temporarily close certain areas. We strive to minimise disruptions and will communicate any significant changes in advance.
4. Payment
4.1. Fees
Membership fees, including any joining fees, must be paid as outlined in your plan. Additional services (personal training, classes, etc.) may incur extra charges.
4.2. Billing
Membership fees are billed fortnightly/pre-paid. Payments can be made via credit card, debit card, or direct debit. Ensure your payment information is up to date to avoid disruptions.
4.3. Late Payments
Late payments may incur additional fees. Continued non-payment may result in membership suspension or termination.
5. Privacy
5.1. Personal Information
We collect personal information for membership management and service provision. FITGym respects your privacy and complies with applicable data protection laws. Please refer to our Privacy Policy for more details.
5.2. Data Security
We implement security measures to protect your personal data. However, we cannot guarantee absolute security, and you acknowledge any data you submit is at your own risk.
6. Liability
6.1. General Liability
FITGym is not liable for loss or damage of personal property, injury, or death resulting from the use of our facilities or services, except where such liability is legally mandated.
6.2. Indemnification
Members agree to indemnify FITGym, its staff, and representatives against any claims, damages, or expenses arising from their use of the gym.
7. Amendments
7.1. Changes to Terms
FITGym reserves the right to amend these Terms at any time. Changes will be communicated via our website or email. Continued use of our services signifies acceptance of the updated Terms.
8. Governing Law
8.1. Jurisdiction
These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the courts of Auckland.
